End-User License Agreement

This End-User License Agreement ("Agreement") is a legally binding agreement between you ("Licensee" or "User") and Yayasan Peta Bencana ("Licensor") governing the use of PetaBencana.id data, including but not limited to all datasets and accompanying materials ("Data").

1. License Grant

   • 1.1 Non-Commercial Use: For non-commercial purposes, the Data is licensed under a Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0) license. Under this license, non-commercial users may use, share, and adapt the Data freely, provided proper attribution is given to PetaBencana.id.

   • 1.2 Commercial Use: For commercial use, the Data is licensed under a Creative Commons Attribution 4.0 International (CC BY 4.0) license. Commercial users must obtain a commercial license by contacting Yayasan Peta Bencana and are permitted to use the Data in their business operations with appropriate attribution to PetaBencana.id.

2. Use Restrictions

   • 2.1 Prohibited Uses: Users may not:

     • Use the Data for any unlawful or unauthorized purpose.

     • Distribute or sublicense the Data for commercial purposes without express permission under the Commercial Use license.

     • Alter, modify, or create derivative works that distort the accuracy of the Data.

   • 2.2 Attribution Requirement: Both non-commercial and commercial users must credit PetaBencana.id when using the Data publicly, following the attribution guidelines provided in Section 4.

3. Data Integrity and Updates

   • 3.1 Accuracy: While Yayasan Peta Bencana strives to ensure Data accuracy, the Data is provided on an "as-is" basis, with no warranties or guarantees regarding its completeness, reliability, or fitness for any particular purpose.

   • 3.2 Updates: Users will receive updates to the Data as made available by Yayasan Peta Bencana . Yayasan Peta Bencana reserves the right to modify or discontinue access to the Data at its discretion.

4. Attribution Requirements

   • 4.1 Non-Commercial Use: When using the Data, non-commercial users must include the following attribution: "Data provided by PetaBencana.id, licensed under CC BY-NC 4.0.," linked to the organization’s website or other specified resource.

   • 4.2 Commercial Use: Commercial users must attribute the Data to [Your Organization’s Name] as follows:

     • “Data provided by PetaBencana.id, licensed under CC BY 4.0.” with the option to include the organization’s logo, where possible, for consistent recognition.

5. Limitation of Liability

   • 5.1 Liability: To the fullest extent permitted by law, Yayasan Peta Bencana shall not be liable for any damages, losses, or liabilities arising out of or related to the use or inability to use the Data, whether in contract, tort, or otherwise.

6. Termination

   • 6.1 Termination for Breach: Yayasan Peta Bencana reserves the right to terminate this license if the Licensee fails to comply with the terms of this Agreement. Upon termination, the Licensee must cease all use of the Data and delete any copies in their possession.

   • 6.2 Survival: Sections 5 and 6 of this Agreement will survive any termination or expiration of this Agreement.

7. Miscellaneous

   • 7.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Indonesia.

   • 7.2 Entire Agreement: This Agreement constitutes the entire agreement between Yayasan Peta Bencana and the Licensee regarding the use of the Data and supersedes any prior agreements.

By using or accessing the Data, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
